Art. 1 – Introduction and scope
1.1. This document governs the conditions of access to and use of the website www.differentsailing.it (the “Website”).
1.2. The Website uses the “Different Sailing” trademark and domain name under licence.
1.3. By accessing the Website, the user (the “User”) declares that they have read and accepted these Terms and Conditions of Use, the Privacy Policy, the Cookie Policy and, for purchases, the General Terms of Sale.
1.4. The Company reserves the right to amend these Terms at any time; amendments take effect from the date of publication on the Website.
Art. 2 – Operating entity
2.1. The Website and the commercial activities offered through it (sailing holidays, charters, rentals and maritime brokerage) are operated by:

2.2. Purchase contracts are concluded exclusively with Ecosailing S.r.l., which collects the relevant payments directly.
Art. 3 – Intellectual property
3.1. The “Different Sailing” trademark, the domain name and all distinctive signs are protected under national and EU law on intellectual and industrial property.
3.2. The contents of the Website (texts, images, photographs, logos, graphics, videos) are protected by copyright. Any reproduction, even partial, without prior written authorisation is prohibited.
3.3. The User is authorised solely to consult the Website for personal, non-commercial purposes.
Art. 4 – Limitation of liability
4.1. The Company undertakes to keep the Website up to date and operational, but does not guarantee the continuity of the service or the absence of technical errors.
4.2. The Company is not responsible for the content of third-party websites reachable through links on the Website.
4.3. The User uses the Website at their own risk; the Company is not liable for direct or indirect damages arising from the use of or inability to use the Website, except in cases of wilful misconduct or gross negligence.
Art. 5 – Applicable law and jurisdiction
5.1. These Terms are governed by Italian law.
5.2. For Users who qualify as Consumers under Italian Legislative Decree 206/2005, jurisdiction lies with the court of the Consumer’s place of residence or domicile (art. 66-bis of the Italian Consumer Code). Disputes may also be submitted to the European Commission’s ODR platform.
